On June 29, 2022, the SCCA Legal Committee, along with SCCA’s John Cooper hosted a webinar pertaining to Designating “Special Shifts” under the Operating Engineers Local 12 Master Labor Agreement (MLA).
Recently, a contractor prevailed in a special shift grievance arbitration brought by Local 12. The arbitration decision is a victory for contractors and clarifies what qualifies as evidence of a bona fide job requirement. Brent Garrett, Partner with Atkinson, Andelson, Loya, Ruud & Romo presented the arbitration ruling and best practices for designating special shifts under the MLA.
